Privacy Policy of LMSC Sp. z o. o. limited partnership
This Policy defines the rules for storing and accessing information on User devices using Cookies, which are used to provide electronic services requested by the User, provided by LMSC Sp. z o.o., a limited partnership , with its registered office in Częstochowa. The Administrator makes every organizational and technical effort to ensure the protection of User data.
I. Definitions
- Administrator – means LMSC spółka z ograniczoną odpowiedzialnością spółka komandytowa with its registered office at ul. Wazów 29A, 42-200 Częstochowa, entered into the register of entrepreneurs of the National Court Register maintained by the District Court under the KRS number 0000504819, NIP: 5732849134, REGON: 243536063, which provides services electronically and stores and gains access to information on the User’s devices.
- Cookies – means IT data, in particular small text files, saved and stored on devices through which the User uses the Website pages.
- Own Cookies – means Cookies placed by the Administrator, related to the provision of electronic services by the Administrator via the Website.
- Cookies placed by the Administrator's partners via the Website.
- Website – means the website or application under which the Administrator runs the website operating in the yokuchi.com domain
- Device – means an electronic device through which the User gains access to the Website.
- User – means an entity for which services may be provided electronically in accordance with the Regulations and legal provisions or with whom an Agreement for the provision of services electronically may be concluded.

Information about the data controller
- The controller of Users’ data is LMSC spółka z ograniczoną odpowiedzialnością spółka komandytowa with its registered office at ul. Wazów 29A, 42-200 Częstochowa, entered into the register of entrepreneurs of the National Court Register maintained by the District Court under the KRS number 0000504819, NIP: 5732849134, REGON: 243536063.
- The User's data provided in the registration form/when placing an order in the online store are used to execute the sales contract for products offered by the data controller and to contact the User in order to complete the order.
- The User's data provided when completing the newsletter subscription form is used to send the newsletter to the User.
- User data provided in the contact form is used to respond to User inquiries.
- User data provided in the complaint form is used for the purpose of conducting the complaint procedure.
- Furthermore, the Administrator uses Users' personal data for direct marketing of its own products or services. Users may object to the processing of their personal data for the purposes described in the preceding sentence.
- The user may only receive marketing and commercial information if he or she consents to this.
- Users' personal data are processed by the controller on the basis of Article 6 paragraph 1 subparagraphs a), b), f) of the GDPR.
- The provision of personal data by the User is voluntary, but necessary to achieve the purpose for which the data was provided.
- If the User's data is processed based on consent, the User may withdraw consent at any time by sending an email to office@yokuchi.com. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
- Unless otherwise provided by law, the Data Controller processes the User's personal data for the time necessary to achieve the purposes for which the data were provided to him.
- The user has the following rights:
- the right to request from the Data Controller access to your personal data, their rectification, deletion or restriction of processing,
- the right to object to the processing of his or her personal data,
- the right to data portability,
- the right to withdraw consent to the processing of personal data for a specific purpose, if such consent has been given,
- the right to lodge a complaint with the supervisory authority if the User considers that his or her data is being processed contrary to the law.
- The recipients of the User's personal data are:
- carriers or courier companies to which the Data Controller commissions the shipment,
- entities handling electronic payments in e-shops, via credit card, payment card, electronic transfer,
- entities handling the sending of the newsletter,
- hosting service provider to store personal data on the server,
- the entity implementing and managing the system supporting the data controller's online store.
- The Administrator protects Users' personal data against disclosure to unauthorized persons, including against other cases of disclosure of such data, or their loss and unlawful modification.

Information about cookies
II. Types of Cookies Used
- Cookies used by the Administrator are safe for the User's Device. In particular, it is impossible for viruses or other unwanted software or malware to enter Users' Devices this way. These files allow us to identify the software used by the User and customize the Service for each User. Cookies typically contain the name of the domain they originate from, the duration of their storage on the Device, and an assigned value.
- The Administrator uses two types of cookies: Session cookies: they are stored on the User's Device and remain there until the browser session ends. The stored information is then permanently deleted from the Device's memory. The session cookie mechanism does not allow the collection of any personal data or any confidential information from the User's Device. Persistent cookies: they are stored on the User's Device and remain there until deleted.
- Ending a browser session or turning off the Device does not delete them from the User's Device. The persistent cookie mechanism does not allow for the collection of any personal data or confidential information from the User's Device. The User has the option to limit or disable cookie access to their Device. If this option is used, the Website will still be available for use, except for functions that, by their nature, require cookies.
III. Purposes for which Cookies are used
The Administrator uses Own Cookies for the following purposes: Website configuration: i) adapting the content of the Website's web pages to the User's preferences and optimizing the use of the Website's web pages; ii) recognizing the Website User's device and its location and appropriately displaying the website, tailored to their individual needs; iii) remembering the settings selected by the User and personalizing the User interface, e.g., in terms of the selected language or region of the User's origin; iv) remembering the history of visited pages on the Website in order to recommend content; v) font size, website appearance, etc. User authentication on the Website and ensuring the user's session on the Website: i) maintaining the Website User's session (after logging in), thanks to which the User does not have to re-enter their login and password on every subpage of the Website; ii) correct configuration of selected Website functions, enabling, in particular, verification of the authenticity of the browser session; iii) optimizing and increasing the efficiency of the services provided by the Administrator. Implementing processes necessary for the full functionality of the websites: i) adapting the content of the Website's web pages to the User's preferences and optimizing the use of the Website's web pages. In particular, these files allow for the recognition of the basic parameters of the User's Device and the appropriate display of the website, tailored to their individual needs; ii) proper operation of the affiliate program, enabling, in particular, the verification of the sources of User redirection to the Website's pages. Remembering the user's location; i) correct configuration of selected Website functions, enabling, in particular, the customization of the information provided to the User, taking into account their location. Analyses, research, and audience audits; i) creating anonymous statistics that help understand how Website Users use the Website's pages, which allows for the improvement of their structure and content. Provision of advertising services; i) customization of advertisements for third-party services and products presented via the Website; Ensuring the security and reliability of the website The Service Administrator uses External Cookies for the following purposes: Presenting multimedia content on the Website pages that are downloaded from an external website: i) www.youtube.com [cookie administrator: Google Inc. based in the USA] Collecting general and anonymous static data via analytical tools: I) Google Analytics [cookie administrator: Google Inc. based in the USA] II) Google Adwords [cookie administrator: Google Inc. based in the USA]

IV.
Possibilities of specifying the conditions for storing or accessing Cookies. The User may independently and at any time change the settings for Cookies, specifying the conditions for their storage and access by Cookies to the User's Device. The User may change the settings referred to in the preceding sentence using the web browser settings or by configuring the service. These settings can be changed, in particular, to block the automatic handling of Cookies in the web browser settings or to notify the User each time Cookies are placed on the User's device. Detailed information about the possibilities and methods of handling Cookies is available in the software (web browser) settings. The User may delete Cookies at any time using the available functions in the web browser they use. Restricting the use of Cookies may affect some of the functionalities available on the Service's website.

The Administrator informs that it uses the following technologies to track actions undertaken by the User on the Website:
- Facebook pixel script (provided by Facebook Inc) – to manage Facebook ads and conduct remarketing activities,
- Google Analytics services (provided by Google Inc.) – to analyze website traffic statistics,

Server logs
The Data Controller informs that it also processes operational data related to the use of the Online Store (so-called logs – IP address, domain). This information is used for technical purposes related to the administration of our website servers, as well as for statistical purposes to assist in the administration of the Online Store.

In matters not regulated by the Regulations, the provisions of the Civil Code and relevant acts of Polish law, as well as European Union law, in particular GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC), shall apply.
